FLYING TIGER COPENHAGEN CLUB TERMS

The Flying Tiger Copenhagen Club Terms (“Terms”) apply between Zebra A/S, Danish business registration no. 15 69 04 88 with a registered address on Strandgade 71 – 73, 1401 Copenhagen K ("Flying Tiger Copenhagen") (“we”), (“us”), (“our”) and you, (the “Member”), (“you”). The purpose of the Terms is to define our loyalty program Flying Tiger Copenhagen Club (“FTC Club”) and regulate Members access to and use of it. Before you sign up, we urge you to read these Terms and our Privacy Notice carefully to ensure you know your rights and obligations as a Member of the FTC Club. In addition to this, and when making purchases online, you will also be subject to the terms of our online store webshop, which is accessible here.

1. 1. WHO WE ARE

2. 1.1 FTC Club is a loyalty program that offers special offers and benefits to you when you shop in Flying Tiger Copenhagen’s stores. As a member of the FTC Club, you will have access to earn and redeem certain offers and benefits such as e.g., vouchers or discounts, when shopping at Flying Tiger Copenhagen.

5. 2. HOW TO BECOME A MEMBER

6. 2.1 Membership to FTC Club is free of membership fees.

7. 2.2 To become a member, you have to download the Flying Tiger Copenhagen application (“App”) on your smartphone and create an account in the application (iOS and Android). When you create your account, you only have to provide your country code and telephone number. Subsequently, we will send a text message with a verification code for you. When you have entered the verification code you have to provide your email address. Subsequently when you have accepted these Terms you are registered as a member of the FTC Club.

8. 2.3 By signing up to the FTC Club in accordance with section 2.2 above, you will receive a voucher for a 10% discount on your next purchase in stores located in your country of residence. Specific voucher terms apply – make sure to read these in the App.

9. 2.4 It is a requirement for membership, that:

10. 2.4.1 you are at least eighteen (18) years of age or older; and

11. 2.4.2 you – when signing up - consent to receive marketing from us (see section 4 below).

12. 2.5 The Member is responsible for ensuring that all of the information provided in connection with its membership account is complete and accurate. If there are any changes to the information, the Member is obliged to correct the information immediately directly in the app.

14. 3. MEMBERSHIP AND BENEFITS

15. 3.1 In the App, you have access to your FTC Club membership which you can show in our stores when shopping to redeem vouchers.

16. 3.2 Your membership, offers and benefits are personal and cannot be transferred to others.

17. 3.3 Offers and benefits cannot be paid out to you in cash.

18. 3.4 The FTC Club is a national program and is only valid for purchases made at Flying Tiger stores in United Kingdom. Vouchers and other benefits can only be redeemed for purchases made within United Kingdom.

19. 3.5 The offers and benefits you earn in connection with a purchase, or otherwise receive by being a member of FTC Club, are valid up and until the date of expiry that appears on the voucher starting from when you receive the voucher. The first voucher you receive with the 10 % discount will, however, be valid for a period of 30 days from the time of signup to the FTC Club.

20. 3.6 Other restrictions may apply to specific offers and benefits. In such case, it will appear in the terms connected to the voucher in the App.

22. 4. ACCEPTABLE USE OF MEMBERSHIP

23. 4.1 As a Member of the FTC Club, you agree not to:

• use your membership inappropriately or in any way that breaches these Terms or any applicable local, national or international law or regulation;

• behave fraudulently or attempt or commit fraud or theft in a store and/or online on the webshop;

• provide false information and data in the App; or

• use your membership for any commercial or business purposes.

4.2 The App is downloaded from a third-party platform (App Store and Google Play) in which case you may be required to agree to be bound by the terms and conditions of that third-party which is a contract between you and that third-party.

5. CONSENT TO RECEIVE DIRECT MARKETING

5.1 In order to become a member of the FTC Club, it is a requirement that you consent to receive marketing from us.

5.2 Marketing will solely be sent from Flying Tiger Copenhagen. You will therefore not receive any marketing material from any partners.

5.3 Our marketing consists of email communication about Flying Tiger Copenhagen and its products, incl. newsletters, offers and events with exclusive benefits, ideas, deals, invites to events and contests, and surveys.

5.4 You can always withdraw your consent to receive marketing going forward. Please go to the bottom of a newsletter to unsubscribe. A withdrawal of your consent to receive marketing is not a termination of your membership with FTC Club, see section 8.1.

6. PERSONAL DATA

6.1 When signing up to become member of FTC Club, we process your personal data such as phone number for verification and login purposes, as well as your email address as a unique identifier in our systems and to send you marketing communications. You can find more information on how we collect and process your personal data in our Privacy Notice.

6.2 To the extent Flying Tiger Copenhagen registers your IP address and collects information about you by using cookies, you will be met by a cookie banner in the App. Cookies are text files placed on your computer or mobile device by websites that you visit. Some of these cookies are used to make the FTC Club App work and some are used for gathering website statistics, analyzing user behavior etc. Read more in our Cookie Notice.

7. INTELLECTUAL PROPERTY RIGHTS

7.1 Flying Tiger Copenhagen is the owner or licensee of all intellectual property rights in the App and its content, including but not limited to the Flying Tiger Copenhagen name. Those works are protected by intellectual property laws and treaties around the world. All such rights are reserved. The Member is not granted any right to use and may not use any Flying Tiger Copenhagen property rights except for the purpose of participating in the FTC Club.

7.2   You must not use the App or FTC membership (or any part of them or their content) for commercial purposes. No part of the App (including, without limitation, the text, designs, graphics, photographs and images contained in it) or FTC membership may be copied, reproduced, republished, uploaded, re-posted, modified, transmitted or distributed or otherwise used in any way for any non-personal, public or commercial purpose without our prior written consent.

8. CANCELLATION OF YOUR MEMBERSHIP

8.1 If you wish to terminate your membership with FTC Club, you have the option to delete your profile at any time by contacting our Customer Service through our enquiry form here. You will be asked to provide the email address you used to sign up and your membership ID (9-digit number located under the barcode on your membership card in the App). When your profile is deleted, any accrued vouchers, or other benefits, will be cancelled and will no longer be accessible. A termination of your membership with FTC Club is not considered a withdrawal of your consent to receive marketing from us. If you wish to withdraw your marketing consent, you must follow the procedure set out in section 5.4 above.

8.2 In case you terminate your membership, we will close your profile and delete your personal data in accordance with our legal obligations under applicable privacy laws as set out in our Privacy Notice. When your profile is closed you will not be able to restore your profile.

8.3 In case you violate these Terms materially or misuse your membership, we may terminate your membership immediately. In this respect, any violation of section 4 on acceptable use of your membership will always be considered a material breach of the Terms. In such case, any accrued vouchers, or other benefits, will be cancelled and will no longer be accessible.

8.4 Flying Tiger Copenhagen reserves the right to terminate the Terms for convenience with thirty (30) days written notice to expire at the end of the month, by contacting the Member via the contact details provided. In such case, any earned vouchers will be redeemable until the expiry date of the voucher.

9. LIMITATION OF LIABILITY

9.1 Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; and (c) any matter in respect of which it would be unlawful for us to exclude or restrict our liability.

9.2 Flying Tiger Copenhagen does not guarantee uninterrupted access to the FTC Club and App. Flying Tiger Copenhagen cannot be held liable for such interruptions or for the consequences resulting from any malfunction in the FTC Club or App, unless Flying Tiger Copenhagen culpably caused a damage to you.

9.3 If we fail to comply with these Terms, we will be responsible for loss or damage that you suffer that is a reasonably foreseeable consequence of our breach of these Terms or our negligence. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time that you accessed the App or FTC membership. We are not responsible for any loss or damage that is not foreseeable.

9.4 Nothing in these Terms affects your statutory rights. Advice about your statutory rights is available from your local Citizens' Advice Bureau or Trading Standards Office.

9.5 Subject to sections 9.1 to 9.4 above, our total liability to you for any loss or damage arising out of or in connection with these Terms, whether in contract (including under any indemnity), tort (including negligence) or otherwise shall be limited to £100.

10. SEVERABILITY

Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

11. MANDATORY LOCAL LAW

These Terms does not affect any mandatory local law applicable in your country of habitual residence and the Terms shall not deprive you of the protection given to you by provisions which cannot be derogated from by agreement.

12. UPDATES TO THESE TERMS

Flying Tiger Copenhagen reserves the right to revise or alter these Terms and/or to modify, close, or restructure the FTC Club from time to time for any operational or commercial reason and without prior notice. If, however, there are any material changes or amendments to the Terms or the FTC Club, that have an adverse impact on the Member, Flying Tiger will give notice of this either through email or the App. By continuing to use the App after the revised terms come into effect, you will be considered to have accepted the changes. However, if the changes are related to personal data matters that require your consent, we will obtain your active consent in compliance with the relevant data protection regulations.

13. GOVERNING LAW AND JURISDICTION

13.1 Governing Law: These Terms shall be governed by and construed in accordance with English law. This means that your access to and use of the App or FTC Club membership, and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims) will be governed by English law.

13.2 Venue: You may bring any dispute or proceedings which may arise under these Terms to, at your discretion, either the competent courts of England, or to the competent courts of your country of habitual residence if this country of habitual residence is within the UK or is an EU Member State, which courts are (with the exclusion of any other court) competent to settle any such dispute. We shall bring any dispute which may arise under these Terms and Conditions to the competent courts of your country of habitual residence if this is within the UK or is an EU Member State or otherwise the competent courts of England.
