FLYING TIGER COPENHAGEN CLUB TERMS

The Flying Tiger Copenhagen Club Terms (“Terms”) apply between Zebra A/S, Danish business registration no. 15 69 04 88 with a registered address on Strandgade 71 – 73, 1401 Copenhagen K ("Flying Tiger Copenhagen") (“we”), (“us”), (“our”) and you, (the “Member”), (“you”). The purpose of the Terms is to define our loyalty program Flying Tiger Copenhagen Club (the “Club”) and regulate Members access to and use of it. Before you sign up, you are required to read these Terms carefully to ensure you know your rights and obligations, and you agree to be bound bound by them. Please also read our Privacy Notice carefully to ensure you understand how we process your personal data as a Club Member. In addition to this, and when making purchases online, you will also be subject to the terms of our online store webshop, which are accessible here.

 

  1. 1. WHO WE ARE

  2. 1.1 The Club is a loyalty program owned and operated by Flying Tiger Copenhagen that offers special offers and benefits to you when you shop in Flying Tiger Copenhagen’s stores. As a member of the Club, you will have access to earn and redeem certain offers and benefits such as e.g., vouchers or discounts, when shopping at Flying Tiger Copenhagen

  5. 2. HOW TO BECOME A MEMBER

  6. 2.1 Membership to the Club is free of membership fees.

  7. 2.2 To become a member, you have to download the Flying Tiger Copenhagen application (“App”) on your smartphone and create an account in the App (iOS and Android). When you create your account, you only have to provide your country code and telephone number. Subsequently, we will send a text message with a verification code for you. When you have entered the verification code you have to provide your email address. Subsequently when you have accepted these Terms you are registered as a Member of the Club.

  8. 2.3 By signing up to the Club in accordance with section 2.2 above, you will receive a voucher for a 10% discount on your next purchase in stores located in your country of residence. Additional specific voucher terms apply – make sure to read these in the App.

  9. 2.4 It is a requirement for your membership, that:

2.4.1 you are at least eighteen (18) years of age or older; and

    1. 2.4.2 you – when signing up - consent to receive marketing from us (see section 4 below).

  1. 2.5 As a member you are responsible for ensuring that all of the information provided in connection with its membership account is complete and accurate. You will not be able to register as a member of the Club if the information that you provide is not accurate. If after registration there are any changes to the information, you are as Member obliged to correct the information without undue delay directly in the App.

  3. 3. MEMBERSHIP AND BENEFITS

  4. 3.1 In the App, you have access to your Club membership which you can show in our Flying Tiger Copenhagen stores in Ireland when shopping to redeem vouchers or other benefits.

  5. 3.2 Your membership, offers and benefits are personal and cannot be transferred to others.

  6. 3.3 Offers and benefits have no cash value, they cannot be sold, and they cannot be paid out to you in cash.

  7. 3.4 The Club is a national program and is only valid for purchases made at Flying Tiger Copenhagen stores in Ireland. Vouchers and other benefits can only be redeemed for purchases made Ireland.

  8. 3.5 The offers and benefits you earn in connection with a purchase, or otherwise receive by being a member of the Club, are valid up and until the date of expiry that appears on the voucher starting from when you receive the voucher.The first voucher you receive with the 10 % discount will, however, be valid for a period of 30 days from the time of sign-up to the Club.

  9. 3.6 Vouchers or other types of discounts will not be valid for redemption in connection with any other offers or promotions.

  10. 3.7 Vouchers and other types of discounts cannot be used on gift cards.

  11. 3.8 Other restrictions may apply to specific vouchers and other offers and benefits. In such case, it will appear in the terms connected to the voucher, offers and benefits in the App.

  13. 4. ACCEPTABLE USE OF MEMBERSHIP

  14. 4.1 As a Member of the FTC Club, you agree not to:

  • use your membership inappropriately or in any way that breaches these Terms or any applicable local, national or international law or regulation;

  • behave fraudulently or attempt or commit fraud or theft or otherwise behave unlawful in a Flying Tiger Copenhagen store and/or online on the Flying Tiger Copenhagen webshop;

  • provide false information and data in the App; or

  • use your membership for any commercial or business purposes.

4.2 The App is downloaded from a third-party platform (App Store and Google Play) and therefore you will be required to agree to be bound by the terms and conditions of that third-party which is a contract between you and that third-party.

 

5. CONSENT TO RECEIVE DIRECT MARKETING

5.1 In order to become a member of the Club, it is a requirement that you consent to receive marketing from us.

5.2 Marketing will solely be sent from Flying Tiger Copenhagen. You will therefore not receive any marketing material from any partners.

5.3 Our marketing consists of email communication about Flying Tiger Copenhagen and its products, incl. newsletters, offers and events with exclusive benefits, ideas, deals, invites to events and contests, and surveys.

5.4 You can always withdraw your consent to receive marketing with effect for the future. You can opt-out of your marketing by unsubscribing directly in the App, or by clicking the link at the bottom of a newsletter. A withdrawal of your consent to receive marketing is not a termination of your membership with the Club, see section 8.1.

 

6. PERSONAL DATA

6.1 When signing up to become member of the Club, we process your personal data such as phone number for verification and login purposes, as well as your email address as a unique identifier in our systems and to send you marketing communications. You can find more information on how we collect and process your personal data in our Privacy Notice.

6.2 To the extent Flying Tiger Copenhagen registers your IP address and collects information about you by using cookies, you will be met by a cookie banner in the App. Cookies are text files placed on your computer or mobile device by websites that you visit. Some of these cookies are used to make the Club App work and some are used for gathering website statistics, analyzing user behavior etc. Read more in our Cookie Notice.

 

7. INTELLECTUAL PROPERTY RIGHTS

7.1 Flying Tiger Copenhagen is the owner or licensee of all intellectual property rights in the App and its content, including but not limited to the Flying Tiger Copenhagen name. Those works are protected by intellectual property laws and treaties around the world. All such rights are reserved. The Member is not granted any right to use and may not use any Flying Tiger Copenhagen property rights except for the purpose of participating in the Club.

7.2 You must not use the App or Club membership (or any part of them or their content) for commercial purposes. No part of the App (including, without limitation, the text, designs, graphics, photographs and images contained in it) or Club membership may be copied, reproduced, republished, uploaded, re-posted, modified, transmitted or distributed or otherwise used in any way for any non-personal, public or commercial purpose without our prior written consent.

 

8. CANCELLATION OF YOUR MEMBERSHIP

8.1 You may terminate your membership with the Club at any time. If you wish to terminate your membership with the Club, you have the option to delete your profile at any time by deleting it directly in the App, or by contacting our Customer Service through our enquiry form here. If the latter, you will be asked to provide the email address you used to sign up and your membership ID (9-digit number located under the barcode on your membership card in the App). When your profile is deleted, any accrued vouchers, or other benefits, will be cancelled and will no longer be accessible. A termination of your membership with the Club is also considered a withdrawal of your consent to receive marketing from us.

8.2 In case you terminate your membership, we will close your profile and delete your personal data in accordance with our legal obligations under applicable privacy laws as set out in our Privacy Notice. When your profile is closed you will not be able to restore your profile.

8.3 In case you breach these Terms materially, we may terminate your membership immediately. In this respect, any breach of section 4 on acceptable use of your membership will always be considered a material breach of the Terms. In such case, any accrued vouchers, or other benefits, will be cancelled and will no longer be accessible.

8.4 Flying Tiger Copenhagen reserves the right to terminate the Terms for convenience with thirty (30) days written notice to expire at the end of the month, by contacting the Member via the contact details provided. In such case, any earned vouchers will be redeemable until the expiry date of the voucher.

 

9. LIMITATION OF LIABILITY

9.1 Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; and (c) any matter in respect of which it would be unlawful for us to exclude or restrict our liability.

9.2 Flying Tiger Copenhagen does not guarantee uninterrupted access to the Club and App. Flying Tiger Copenhagen cannot be held liable for such interruptions or for the consequences resulting from any malfunction in the Club or App, unless Flying Tiger Copenhagen culpably caused a damage to you.

9.3 Nothing in these Terms affects your statutory rights.

 

10. SEVERABILITY

10.1 In case any provision of these Terms is or will be held invalid, the remainder of the Terms shall continue in full force and effect. To the extent that the provisions are invalid, the content of the Terms shall be governed by mandatory local law.

These Terms does not affect any mandatory local law applicable in your country of habitual residence and the Terms shall not deprive you of the protection given to you by provisions which cannot be derogated from by agreement.

 

11. UPDATES TO THESE TERMS

Flying Tiger Copenhagen reserves the right to revise or alter these Terms and/or to modify, close, or restructure the Club from time to time for any operational or commercial reason and without prior notice. If you are a registered member, we will provide you with notice within reasonable time of any material changes as well as any change that has an adverse impact on you, through email or the App, (unless the change is due to a change in law or for security reasons, in which case, we may need to make changes on shorter notice). If you do not wish to continue using your membership following the changes, you can cancel your membership without penalty at any time (see section 8 of these Terms). By continuing to use the App after the revised terms come into effect, you will be considered to have accepted the changes. However, if the changes are related to personal data matters that require your consent, we will obtain your active consent in compliance with the relevant data protection regulations.

 

12. GOVERNING LAW AND JURISDICTION

12.1 Governing Law: These Terms shall be governed by and construed in accordance with the substantive laws of Ireland.

12.2 Dispute resolution: If you wish to have more information on online dispute resolution, please follow this link to the website of the European Commission: http://ec.europa.eu/consumers/odr/ This link is provided as required by the Regulation (EU) No 524/2013 of the European Parliament and of the Council, for information purposes only. We are not obliged to participate in this online dispute resolution.

12.3 Venue: You may bring proceedings which may arise under these Terms to, at your discretion, either to the competent court of Denmark, or to the competent court of your country of habitual residence if this country of habitual residence is within an EU Member State. We shall bring any

dispute which may arise under these Terms to the competent court of your country of habitual residence if this is in within an EU Member State.
